The applicant has filed this suit complaining infringement of trademark and passing off by the respondents.

2. It is asserted by the applicant in the affidavit filed in support of this application that the offending goods are being sold by the second respondent within the jurisdiction of this Court and hence, part of cause of action arose within the territorial limits of this Court.
