Respondent PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the learned Metropolitan Magistrate for exclusive trial of CCB Cases and CBCID Metro Cases, Egmore, Chennai, expedite the trial in C.C.No.12553 of 2022 on day to day basis and complete the same within the stipulated time as fixed by this Court.

O R D E R

Today, this matter is listed before this Court under the caption 'For Being Mentioned' at the instance of the learned counsel appearing for the petitioner.

The learned counsel appearing for the petitioner submitted that this Court by an order dated 03.04.2025, dismissed the petition with direction to the trial Court to dispose of the discharge petition within a period of four weeks. He further submitted that the petitioner is the defacto complainant and he filed the present petition to expedite the trial. However, in paragraph No.2, it was wrongly mentioned that the petitioner is an accused and he filed the discharge petition. Hence he prayed for necessary direction.

Considering the above submissions, the paragraph Nos.3 & 4 of the order dated 03.04.2025 in Crl.O.P.No.9900 of 2025 shall read as follows.

"3. The petitioner had filed a complaint as against the accused persons in Crime No.45 of 2020 and after completion of investigation the respondent filed final report and the same has been taken cognizance by the

learned Metropolitan Magistrate for exclusive trial of CCB Cases and CBCID Metro Cases, Egmore, Chennai, in C.C.No.12553 of 2022. Since the same was pending for the past three years without any progress, the petitioner filed this present petition.

4. Considering the limited prayer sought for in this petition, the learned Metropolitan Magistrate for exclusive trial of CCB Cases and CBCID Metro Cases, Egmore, Chennai, is directed to complete the Trial in C.C.No.12553 of 2022, within a period of six months from the date of receipt of a copy of this order, if not already disposed of.

With the above directions, this Criminal Original Petition stands disposed of."

Registry is directed to carryout the above correction and issue order copy afresh.
