C.M.P.No.9622 of 2023 in C.M.A.SR.No.50400 of 2023 N.MALA,J, This petition is filed to condone the delay of 316 days in filing the above C.M.A.SR.No.50400 of 2023.
2.Notice to the 1st respondent is dispensed with (Vide CMP & Batta).
3. Mrs.R.Sreevidhya, learned counsel appears for the 2nd respondent and she fairly submits that she has no objection to the delay of 316 days being condoned, subject to the condition that the petitioners/claimants shall not be entitled to interest for the delay period of 316 days.
4. In view of the above submissions, the delay of 316 days is condoned and the petition is accordingly ordered, on condition that the petitioners shall forfeit the interest for the delay period of 316 days.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission and print the name of Mrs.R.Sreevidhya, as the counsel for the second respondent at the time of admission.
