Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus to call for records of the first respondent dated 27.07.2018, in Letter No.CUTN-19 (4) 2012-Sec Vol II (ADMN) 651 and to quash the same and consequently, to forbear the first respondent from giving effect to the order, dated 27.07.2018 particularly by terminating the petitioner from service as Head Security Guard in the first respondent till the agreement period date 30.11.2018 is over based on the agreement dated 27.06.2017 executed between the first respondent and second respondent. O R D E R

Heard Dr.P.Vasudevan, learned counsel appearing for the petitioner. Considering the nature of order that is to be passed herein, notice to the respondents is dispensed witih.

The second respondent, Tamil Nadu Ex Servicemen's Corporation Ltd., (TEXCO) which is a State Government Undertaking is providing employees, who are ex-servicemen, to various Institutions, like Government and other Sectors. While so, the first respondent entered into an agreement with the https://hcservices.ecourts.gov.in/hcservices/

second respondent for supply of certain employees. However, later, there being no requirement, the first respondent requested the second respondent to reduce the strength of manpower to 40. The petitioner, who is stated to be deployed by the second respondent and one among the employees relieved, being aggrieved by such reduction, has come to this Court challenging the same on the ground that without notice to him, such an order of depleting the strength of the persons to be posted could not have been made. I am of the view such a prayer of the petitioner cannot be entertained in this Writ Petition, inasmuch, he was a labour employed directly by the second respondent and the first respondent had outsourced certain employees through the Chairman of the second respondent, TEXCO.

Therefore, the petitioner's prayer to injunct the first respondent to act on the same is totally devoid of merit, and accordingly, this Court is not inclined to issue notice on the same and dismiss the Writ Petition at the stage of admission. No costs. Consequently, connected Writ Miscellaneous Petitions are closed.
