Prayer: Criminal Original Petition is filed under Section 438 Cr.P.C., praying to enlarge the petitioners on bail in the event of their arrest in connection with in Crime No.167 of 2021 on the file of respondent police.

ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 8 (c) r/w. 20(b)(ii)(B) of NDPS Act in Crime No.167 of 2021, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners were found in possession of 25 Kgs of Ganja . Hence, a case was registered against the petitioners.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioners were found in possession of 25 Kgs. and 200 gms. of Ganja in dump yard. He would further submit that the petitioners have already been detained under Goondas Act and both the petitioners are having more previous cases. Hence, he vehemently oppose to grant anticipatory bail to the petitioners. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the fact that the petitioners are having more previous cases and the petitioners have already been detained under Goondas Act, this Court is not inclined to grant anticipatory bail to the petitioners and accordingly, this Criminal Original Petition stands dismissed.
