T.Prema, v. The Block Development Officer,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 17.01.2018
CORAM:
THE HONOURABLE MR. JUSTICE K.KALYANASUNDARAM W.P. No.5068 of 2012 & M.P.Nos.1 and 2 of 2012 T.Prema .. Petitioner Vs.
The Block Development Officer, (Village Panchayat), Pollachi North Panchayat Union, Pollachi, Coimbatore District.
.. Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari, to call for the entire records relating to the impugned order passed by the respondent in his proceedings Na.Ka.No.2234/08/E1, dated 20.02.2012 and quash the same. For Petitioner : Mr.C.Prakasam For Respondent : Mr.D.Suriyanarayanan
O R D E R
Heard Mr.C.Prakasam, learned counsel for the petitioner and Mr.D.Suriyanarayanan, learned counsel for the respondent and perused the record.
2. This Writ Petition has been filed challenging the order of the respondent directing the petitioner to handover the key of the shop No.7, within a period of 7 days.
3. According to the petitioner, she is the Coordinator of Annai Therasa Women Weavers Self Help Group and it was formed with an object to sell the handloom sarees produced by its members. The respondent constructed 15 shops under Scheme of Women Self Help Group funded by the Government and the petitioner was allotted Shop No.7 on 20.04.2004.
4. According to the respondent, the petitioner had sub-let the premises to third parties in violation of the agreement and since the object of the scheme was defeated, they issued the impugned notice.
5. Though the counsel for the petitioner has vehemently
contended that the petitioner has been running the shop from the year 2004, in support of the contention, no document was produced. Before passing the impugned order, the Panchayat Union had passed a Resolution dated 16.11.2011 to take action against the petitioner. The said Resolution was not challenged by the petitioner in the manner known to law. Since the petitioner has not produced any material to substantiate her case that she has been running the shop from the year 2004, this Court does not find any merit in the Writ Petition.
6. Accordingly, the Writ Petition fails and the same is dismissed. There is no order as to costs. Consequently, connected miscellaneous petitions are closed.
