No.5387 of 2025 by permitting the appellant to furnish Bank Guarantee for 50 Percentage of the decree amount to be deposited in the credit of C.O.S. ORDER

(Order of the Court was made by Dr.G.JAYACHANDRAN, J.) The present Civil Miscellaneous Petition has been filed seeking modification of the order of this Court dated 10.03.2025 passed in C.M.P. No.5387 of 2025, whereby the appellant was permitted to furnish a Bank Guarantee for 50% of the decree amount to be deposited to the credit of C.O.S. No.29 of 2023 on the file of the Principal Commercial Court at Chennai.

2. Heard the learned counsel appearing on either side.

3. In compliance of the order passed by this Court dated 22.09.2025, the petitioner/appellant had taken a Bank Guarantee for a sum of Rs.90,01,800/-, which is 75% of the decreetal amount. The copy of the Bank Guarantee has also been furnished. The petitioner/appellant is directed to keep the Bank Guarantee alive till the disposal of the appeal.

4. Accordingly, the order dated 10.03.2025 passed in C.M.P.No.5387 of 2025 is modified to the aforesaid extent.
