Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to issue appropriate directions to the 2nd respondent to immediately unfreeze the petitioner's bank account bearing account no.(130801000020731) maintained with the 2nd respondent bank thereby enabling the petitioner to continue to operate his business without obstruction.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the second respondent to immediately defreeze the petitioner's bank account bearing Account No.130801000020731 maintained with the 2nd respondent bank thereby enabling the petitioner to continue operating his business without any obstruction.

2. Heard Ms.T.Madhumitha, the learned counsel for the petitioner, Mr.R.Vinothraja, learned Government Advocate (Crl.Side) for the first respondent and perused the materials available on record.

3. The petitioner is an accused in Crime No.421 of 2023 for the offences under Sections 272, 273 and 328 of IPC. Pursuant to the registration of the FIR, on the request made by the first respondent, the the petitioner's bank account was frozen by the second respondent. Now, the investigation has been completed and the final report was filed on 01.04.2025 before the concerned jurisdictional Magistrate. The continued freezing of the petitioner's account would not serve any purpose, since final report was already filed.

4. In view of the above, the account of the petitioner in

Account No.130801000020731 is hereby defreezed. The second respondent is directed to permit the petitioner to operate his account.

5. With the above direction, this Criminal Original Petition stands disposed of.
