Respondents PRAYER : Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Mandamus to call for the entire records connected with the impugned order passed by the second respondent in Se.Mu. Order No. Nir.3/15913/09 dated 28.05.2009 (Served on 09.06.2009) and quash the same with the consequential direction, directing the respondents to retain the petitioner at Villupuram.

O R D E R

The prayer in the writ petition is to call for the entire records connected with the impugned order passed by the second respondent in Se.Mu. Order No. Nir.3/15913/09 dated 28.05.2009 (Served on 09.06.2009) and quash the same with the consequential direction, directing the respondents to retain the petitioner at Villupuram.

2. Today, when the matter is taken up for consideration, the learned Counsel for the petitioner submitted that the prayer sought for has become infructuous and he has also made an endorsement to that effect:

"Since the petitioner has challenged the validity of the order of transfer, now the writ petition is become infructuous."

3. In view of the submissions and the endorsement made by the learned counsel for the petitioner, nothing survives for consideration and no further adjudication is required to be made in this writ petition. Accordingly, the writ petition is dismissed as having become infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
