ORDER

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326 of BNS, in Crime No.28 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, had illegally transported quarter unit of river sand without any valid permit through a bullock cart. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. It was further submitted that the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the allegation against the petitioner is serious in nature and further, the petitioner has one previous case similar in nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel on either side and perused the materials available on record.

6.Taking into account the serious nature of the act committed by the petitioner, this Court is of the view that the petitioner is a repeat offender. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
