ORDER
Heard both sides and perused the materials placed on record.

Earlier this Court had granted anticipatory bail in Crl.O.P.No. 29989 of 2024, dated 03.01.2025 to the petitioner with certain conditions which reads as follows:- (a) if the petitioner fails to surrender before the said Magistrate within a period of fifteen days, this Court shall stand automatically cancelled; (b) the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of one week and thereafter, as and when required for investigation;
(c) the petitioner shall not tamper with evidence or witness either during investigation or trial; (d) the petitioner shall not abscond either during investigation or trial;
(e) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions
have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560];
(f) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
3. Pursuant to the earlier order passed by this Court, the respondent has deliberately failed to comply with the conditions imposed by this Court in Crl.O.P.No.29989 of 2024, dated 03.01.2025. Therefore, the Petitioner/Investigating Officer has filed the present petition seeking to cancel the anticipatory bail already granted to the respondent herein.

This Court ordered notice as well as private notice to the respondent and the same was also returned with an endorsement as "Unserved" and the name of the respondent was also printed in the cause list. The petitioner herein has not appeared before the learned Judicial Magistrate concerned to execute sureties and wantonly failed to comply
with the conditions imposed by this Court. Therefore, I am of the view that the anticipatory bail had already granted to the petitioner in Crl.O.P.No. 29989 of 2024, dated 03.01.2025 by this Court is liable to be cancelled.
