This petition is filed to permit the petitioner to withdraw the sum of Rs.5 lakhs deposited on 03.07.2023 by the petitioners to the credit of Crime No.216 of 2023 on the file of the respondent police station as per E-challan dated 02.03.2023 and produced before the Judicial Magistrate Court, Omalur, in Crl.O.P.No.9107 of 2023, order dated 09.06.2023.

The learned counsel for the petitioners submits they filed an application for anticipatory bail in Crl.O.P.No.9107 of 2023, while granting an order of anticipatory bail on 09.06.2023, this Court directed to deposit a sum of Rs.5 lakhs to the credit of Crime No.216 of 2023 without prejudice to their rights and contentions before the Trial Court, besides imposing other conditions. The learned counsel further submits that petitioners have complied with the said condition within the stipulated time and the money is lying in deposit and copy of E-challan dated 02.03.2023 as a proof of deposit of the same on the file of the Judicial Magistrate Court, Omalur.

3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

4. Considering the facts and circumstances of the case and also the reasons stated in the affidavit filed by the petitioners this petition needs to be considered favourably. Therefore petitioners are permitted to withdraw the aforesaid amount deposited before the concerned Magistrate by filing undertaking affidavit and proper identification and acknowledgment. Accordingly, this petition is ordered.
