ORDER

The petitioner / Accused, who apprehends arrest in the hands of the respondent police for the offences punishable under Section 4(1)(C) and 14A of Tamil Nadu Prohibition (Amendment) Act, 2024 in connection with the Cr. No.30 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that on 22.02.2026 at about 11 hours, during the routine patrol duty, when the respondent police intercepted a Tata Indica Car bearing Registration No.TN11 E 5469 and enquired, they found the accused were in illegal possession of Majestic Brandy 90 ml - 46 bottles and Men's Black Brandy 90 ml - 40 bottles without valid license or permission and hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that he is ready and willing to abide by any condition that may be imposed by this Court and prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and strongly opposed to grant

anticipatory bail to the petitioner on the ground that the accused were found in illegal possession of liquor bottles and the same were recovered and investigation is pending.

5. The learned Government Advocate strongly opposed the bail application stating that this is a case of illegal possession of liquor bottles. Therefore, considering the nature of allegations against the petitioner that he has involved in the activities prohibited under the Tamil Nadu Prohibition Act, this Court is of the view that the petitioner does not deserve for anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 26-03-2026 MJS Note:
