C O M M O N O R D E R These Criminal Original Petitions are filed to call for the records in F.I.R Nos.1294 of 2010 & 1295 of 2010 on the file of the Inspector of Police, K-3 Police Station, Chennai.

The Learned Counsel for the petitioner states that the investigation in F.I.R.Nos.1294 of 2010 and 1295 of 2010 relates to job racketeering attracting offences under Section 420, 468 and 471 of I.P.C. Both the complaints were registered in the year 2010, even after 14 years investigation not yet completed. The accused is put to sufferance due to prolong pending of the said criminal case.

3. The Learned Govt. Advocate (Crl.Side) for the 1st respondent states that it is a matter relates to forgery of documents and there was some delay in completing the investigation. There are ample materials available to frame charge against the petitioner/accused and proceed with the criminal prosecution. The investigation has already completed and draft final report is made ready and will be filed within a period of 10 days. 2/4

4. In view of the above fact, this Court is of the view that the petition to quash the F.I.R cannot be entertained in view of the materials collected in the course of the investigation. After filing the final report, if there is any material to challenge the charge framed, it is open to the petitioner to agitate the said remedy in the manner known to law.

5. With this observation, these Criminal Original Petitions are disposed of. Consequently, connected Miscellaneous Petitions are closed. 07.06.2024 Index : Yes/No.
