ORDER

The petitioner who was arrested on 09.04.2021 and remanded to judicial custody for the offences under Sections 174 Cr.P.C.., altered into 302 of IPC in Cr.No.91 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the marriage between the deceased and petitioner was solemnised on 09.04.2017 and that for the past four years, the deceased did not bear child. Subsequently, the petitioner herein developed illegal relationship with some other women. When the wife of the petitioner/deceased came to know about the same, misunderstanding developed between them and that on the date of occurrence, there was a wordy quarrel between them. Subsequently, this petitioner had intimated the parents of the deceased that she committed suicide. The case was originally registered under 174 Cr.P.C., but, on investigation the respondent police came to know that the petitioner had committed the murder of the deceased hence, the case was altered to Section 302 IPC.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in https://hcservices.ecourts.gov.in/hcservices/

this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) vehemently opposed for grant of bail to the petitioner stating that the investigation is still under the initial stages.

5.Considering the stage of investigation and also the gravity of the offence, this is not a fit case for grant of bail. Therefore, this Criminal Original Petition is dismissed.
