2. Despite private notice having been served and a proof to that effect has been filed by the learned counsel appearing for the petitioner, there is no representation for the respondent.

3. Since the delay is 70 days, having satisfied with the reasons stated in the affidavit filed in support of the petition, we are inclined to allow this petition and accordingly, this petition is ordered and the delay is condoned.
