O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 366A of I.P.C. and Section 4 of POCSO Act, in Crime No.207 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner came to village of the victim girl, who is aged about 17 years, and took her somewhere. Hence, a case was registered against the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the victim girl is aged about 17 years and the statement under Section 164 Cr.P.C. has been recorded from the victim girl. He would further submit that the investigation is still pending. Hence, he vehemently oppose to grant anticipatory bail to the petitioner.

5. Considering the fact that the victim is the minor girl and the investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this Criminal Original Petition stands dismissed.
