O R D E R
This Original Petition has been filed for appointment of an independent and impartial Arbitrator to resolve the disputes between the petitioner and the respondent arising out of the Agreement dated 06.04.2012.
2. Heard the learned counsel for the petitioner through video conferencing.
3. The learned counsel for the respondent submitted that he is filing the vakalat today and he has no objection for appointing any of the retired High Court Judges, as sole Arbitrator and last hearing also he made such representation.
4. In such view of the matter and having regard to the Agreement dated 06.04.2012 entered into between the parties and with the consent of both sides, it is ordered as follows: i) Honourable Mr.Justice K.Mohan Ram, Judge (Retired), High Court of Madras, residing at "ISHANA", Plot No.15B, Radiant 2/4
Avenue, 5th Street, VGP Golden Beach Layout, Injambakkam, ECR, Chennai - 600 115, Contact No.94444 64646, is appointed as the Arbitrator to enter upon reference and adjudicate the disputes inter se the parties. ii) The learned Arbitrator may, after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of the order.
iii) The learned Arbitrator is at liberty to fix his remuneration and other incidental expenses.
iv) The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre and in accordance with the Madras High Court Arbitration Rules.
5. The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
