O R D E R

The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Section 392 and 397 IPC, in Cr. No.60 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and the other accused attacked the defacto complainant and snatched the gold jewel from her. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner was arrested by Mettupalayam Police Station in Crime No.81/2021 on 21.01.2021 and remanded to judicial custody and on the same day a false case has been foisted against the petitioner in Crime No.60 of 2021. The learned counsel appearing for the petitioner would further submit that the petitioner is ready to comply with any conditions that may be imposed by this Hon'ble Court and prays to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

The learned Additional Public Prosecutor submitted that the the petitioner and the other accused attacked the defacto complainant and snatched the gold jewel from her and further submitted that there are three cases pending against the petitioner, out of which one case is filed under NDPS Act and two cases are filed under Section 392 IPC and hence, strongly opposed to grant anticipatory bail to the petitioner.

5. Taking note of the facts and circumstances of the case and also the fact that two cases of similar nature are pending against the petitioner, this court is not inclined to grant Anticipatory Bail to the petitioner and accordingly, the Criminal Original Petition is dismissed.
