Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the first respondent to pass orders on the representation made by the petitioner dated 17.02.2022, within a limited time frame as deem fit by this Court, for revision of seniority in the cadre of Assistant Engineer at par with his juniors by taking into consideration the orders passed by the Government in G.O.(D).No.199, Public Works (A1) Department dated 08.12.2020 in the case of Tr.N.N.Thiyagarajan and grant him all consequential service and monetary benefits.

ORDER

This Writ Petition has been filed for a mandamus seeking for a direction to the respondents to pass orders on the petitioner's representation dated 17.02.2022, within a time frame to be fixed by this Court.

2. Heard Mr.Venkataramani for Mr.M. Muthappan, learned counsel for the petitioner. Mr.P. Sanjay Gandhi, learned Government Advocate, accepts notice on behalf of the respondents. By consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The petitioner seeks for revision of seniority in the cadre of Assistant Engineer on par with his juniors by taking into consideration the orders passed by the Government in G.O.(D.) No.199, Public Works (A.1) Department dated 08.12.2020 in the case of Thiru. N.N. Thiyagarajan. 2/4

4. The petitioner has given a representation dated 17.02.2022 in the light of G.O.(D.) No.199, Public Works (A.1) Department dated 08.12.2020. It is for the respondents to consider as to whether the said Government Order can be applied to the case of the petitioner also.

5. No prejudice will be caused to the respondents if the petitioner's representation as stated supra, is considered on merits and in accordance with law, within a time frame to be fixed by this Court.

6. For the foregoing reasons, this Court directs the first respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 17.02.2022, seeking for revision of seniority in the cadre of Assistant Engineer on par with his juniors by taking into consideration the orders passed by the Government in G.O.(D.) No.199, Public Works (A.1) Department dated 08.12.2020 in the case of Thiru. N.N. Thiyagarajan, within a period of twelve (12) weeks from the date of receipt of a copy of this order. However, the petitioner will have to send a copy of the same to the first respondent for his consideration. 3/4
