The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 323 and 506(ii) of I.P.C, in Crime No.Not known of 2018, seek anticipatory bail.
2. Today, when the matter is taken up for hearing, the learned Government Advocate appearing for the respondent Police submitted that the petition enquiry is pending in C.S.R.No.229 of 2021 against the petitioner.
3. The learned Counsel for the petitioner submitted that the respondent police is harassing the petitioner under the guise of enquiry.
4. Considering the facts and circumstances, the respondent police is directed to conduct the enquiry and if any prima facie case is made out against the petitioner, register the F.I.R or close the petition enquiry within a period of two weeks from the date of receipt of a copy of this order. The petitioner is directed to cooperate with the enquiry.
5. Recording the same, this Criminal Original petition is closed. The petitioners shall not be arrested by the respondent / police till the completion of enquiry.
