Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent herein to consider and pass order in T.R.No.3 of 2008 within a stipulated period.

By consent, the writ petition is taken up for final disposal.
2.The petitioner claims that he is the absolute owner of the property admeasuring 8 acres in S.F.No.224/2 situated at Kottur Village, Pollachi Taluk, Coimbatore District and the said lands were purchased by him in a Court Auction held on 24.09.2003 by the District Munsiff Court, Pollachi in E.P.No.590 of 1987 in O.S.No.577 of 1979 and the sale certificate was also issued on 05.12.2003. The petitioner would further state that the said Survey Field was sub divided as S.F.No.224/2A. without arraying the petitioner who is the land owner managed to register themselves as Cultivating tenants under Act X of 1969 and in this regard the petitioner has filed an application to evict them in T.R.No.3 of 2008 and very many years had elapsed, but no orders have been passed and hence, came forward to file this writ petition.
3.Heard the submissions of Mr.K.Govi Ganesan, learned counsel appearing for the petitioner and Mr.M.Digvijaya Pandian, learned Additional Government Pleader who accepts notice on behalf of the first respondent.
4.This Court in the light of the facts and circumstances and without going into the merits of the claim projected by the petitioner permits the petitioner to send a representation/ reminder to the first respondent to dispose of the T.R.No.3 of 2008 within a period of two weeks from the date of receipt of a copy of this order and the first respondent on receipt of the same is directed to consider the said representation as well as the T.R.No.3 of 2008 pending on his file on merits and in accordance with law after putting on notice the respondents 2 to 4 and pass orders within a period of eight weeks thereafter and communicate the decision taken to the petitioner as well as the respondents 2 to 4.
