Prayer: Civil Miscellaneous Appeal filed under Section 151 of the Code of Civil Procedure to modify the interim stay conditional order passed in C.M.P.No. 4379 of 2026 in C.M.A.No. 354 of 2025 dated 19.02.2026.

J U D G M E N T

This petition has been filed seeking to modify the condition passed in C.M.P.No. 4379 of 2026 on 19.02.2026 by a Co-ordinate Bench of this Court while granting stay of the order of the Tribunal / Sub Court, Namakkal, in M.C.O.P.No. 1408 of 2024 by order dated 09.10.2025.

2. The Co-ordinate Bench of this Court, when the Appeal came up for admission, had directed the appellant herein to deposit a sum of Rs.1/- crore to the credit of the Motor Accident Claims Original Petition and that granted time till today to effect such deposit.

3. The learned Additional Advocate General representing the appellant expressed difficulty in effecting such deposit. This petition has therefore been filed. It is urged that this Petition should be considered and the appellant may be permitted to deposit 50 % of the award amount.

4. The Co-ordinate Bench had also directed notice to the respondents.

5. Having heard the learned Additional Advocate General, we would modify the order dated 19.02.2026 and direct the appellant to deposit 50% of the award amount together with interest and costs within a period of four weeks from this date. This Petition stands ordered.

6. Registry may put up a note regarding service or otherwise of the notice to the respondents which had been directed to be issued earlier.

7. The interim stay already granted in C.M.P.No. 4379 of 2026 by this Court is to continue further for a period of four weeks.

8. List the matter after four weeks.
