This Writ Miscellaneous Petition has been filed seeking to restore the above writ petition, which has been Dismissed for Non-Prosecution on 09.02.2022.

2. The affidavit filed in support of the application/petition is perused. It has been filed by the learned counsel for the petitioner himself.

3. The learned counsel mentioned that when the matter was listed on the previous date i.e., on 08.02.2022, he was unwell. Despite the fact, he attended hearing through Video Conferencing and sought for adjournment.

4. To his shock and surprise, the matter has been called on 09.02.2022 under the caption "for dismissal" and he did not represent the matter because of his ill-health. On 09.02.2022, this Court had dismissed the above writ petition for non-prosecution.

5. It is seen that the application/petition has been filed in time. The learned counsel for the petitioner has sworn to the affidavit in support of the application/petition.
