Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondent to dispose of the appeal dated 16.06.2022 and 14.03.2023 within stipulated time.

O R D E R

The learned counsel on behalf of the petitioner made a submission that the Tahsildar who is the competent authority under the Pata Passbook 1/4

Act cancelled the patta granted in favour of the petitioner. Challenging the said order, the petitioner preferred an appeal before the Revenue Divisional Officer who in turn also rejected the appeal and thereafter, the petitioner preferred an appeal before the District Revenue Officer on 16.06.2022 and a reminder was sent on 14.03.2023.

2. In view of the fact that the appeal filed before the District Revenue Officer is a statutory appeal contemplated under the patta Passbook Act 1983, the respondent is directed to conduct an inquiry with reference to the documents and evidence on record and pass final orders by affording opportunity to all the parties on merits and in accordance with law as expeditiously as possible.

3. Accordingly, the writ petition stands disposed of. No costs. (sha) 25.04.2023 Index : Yes Speaking Order 2/4
