Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus forbearing the first and second respondents in approving the widening of the existing 22'' feet road to the "Old Colony" in Kadambai Village, Vandavasi Taluk by the third and fourth respondent by encroaching the petitioner's agricultural land and also causing damages to the paddy crops in either side of the road in respect of the agricultural land comprised in Survey No.144/15A, 144/16, 144/23, 197/5, 144/24, 208/2, 208/6, 144/17, 144/18, 144/2a,

110/5, 110/6 in Block No.78, situated in Kadambai Village, Vandavasi Taluk, Thiruvannamalai District admeasuring about 1.44 acres on the basis of the petitioner's representation dated 29.01.2009.

Ms.Judy, the learned counsel appearing for the petitioner states that pursuant to the filing of the Writ Petition, the respondents have approached the petitioner to resolve the dispute and therefore, the petitioner does not wish to pursue further with the Writ Petition. Therefore, the learned counsel for the petitioner seeks the permission of this Court to withdraw the Writ Petition. She has also made an endorsement to that effect in the petition.

2. In view of the submission coupled with the endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn. In case, grievance of the petitioner is not redressed, liberty is granted to him to approach this Court once again and take appropriate steps in accordance with law. No costs.
