ORDER
(The cases have been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 13.05.2021 for the offence punishable under Section 306 IPC and originally FIR was registered under Section 174 of Cr.P.C and later altered into Section 306 of IPC, in Crime No.144 of 2021 on the file of the respondent, seeks bail.
2.The case of the prosecution is that on 10.05.2021 when the deceased Mrs.Lakshmi bought drinking water in the way of neighboring house, due to previous enmity, the petitioner and other neighboring persons abused and assaulted the deceased and threatened her to commit suicide by herself, otherwise they would kill her and her family members also. Thereby her heart broken and she consumed poison and she died. Hence, the complaint.
3.The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Crl. Side) would vehemently oppose stating that the deceased and the petitioner are neighbors. On the date of occurrence, the petitioner had abused the deceased with filthy language and there were frequent quarrel between them. On the date of occurrence, the petitioner alleged to have abused the deceased and unable to bear it, she alleged to have committed suicide. This case was originally registered under Section 174 Cr.P.C and later altered into Section 306 IPC by the respondent police. The petitioner was only arrested on 13.05.2021. Hence, prays for dismissal of the petition.
5.Taking into consideration of the fact that the petitioner was arrested only on 13.05.2021 and also the investigation is in preliminary stage, this Court is not inclined to grant bail to the petitioner.
6.This Criminal Original Petition stands dismissed accordingly for the present.
