Respondent PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus directing the respondent to sanction family pension to the Petitioner and other pensionary benefits admissible to the Petitioner. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner claims that she is the legally wedded wife of one Mr.Parthasarathy. In all the records such as Ration Card, Voter ID, Death Certificate, Legal Heir Certificate etc., it is stated that the petitioner is the wife of one Parthsarathy. According to the petitioner, Parthasarathy @ Perumal, who was employed in the Respondent Corporation and retired and also obtained pension during his life time, is one and the same. According to the petitioner, in the records of the respondent Corporation, the petitioner is shown as the wife of Perumal. Hence, the petitioner made a representation on 24.06.2015 claiming family pension.

3. Mr.Kannan Kumar, the learned counsel appearing for the Transport Corporation submits that in view of the aforesaid discrepancies, the respondent Corporation is not in a position to disburse the family pension to the petitioner. He would further https://hcservices.ecourts.gov.in/hcservices/

submit that if the petitioner is able to produce proof to the satisfaction of the Corporation that she is the legally wedded wife of deceased Perumal, the Corporation has no objection to give the family pension. Hence, this Court is of the view that it is for the petitioner to establish that she is the legally wedded wife of Perumal in the manner known to law.

4. Accordingly, this writ petition is disposed of recording the statement of the learned counsel for the respondent Corporation. No costs.
