ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 296(b), 126, 74, 75 and 76 of BNS and Section 4 of TNPWH Act the corresponding provisions in IPC are 294, 341, 354, 354A and 354B in Crime No. 62 of 2026, seeks anticipatory

bail.

2. The case of the prosecution is that the petitioner along with other accused abused the de facto complainant in filthy language and assaulted her by tearing her clothes. Hence, the case.

3. The learned counsel for the petitioner submitted that they have falsely implicated the case and the occurrence took place on 17.02.2026 and there is no injury caused to anyone. He further submitted that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and produced the statement of the de facto complainant recorded under section 183(5) of BNSS against the petitioner. He further submitted that the investigation is also in preliminary stage. Hence, he opposed the grant of anticipatory bail to the petitioner.

Considering the facts and circumstances of the case, and considering the statement recorded under 183(5) of BNSS, it is evident that there is serious assault upon the modesty of the de facto complainant by the petitioner and this Court could find the seriousness of the allegation. The occurrence took place on

18.03.2026 and the learned Government Advocate (Crl.Side) submitted that the investigation is also in preliminary stage. Taking into consideration the totality of the circumstances, and the statement made by the de facto complainant before the learned Judicial Magistrate and upon the fact that investigation is still in initial stage, this Court is not inclined to grant anticipatory bail to the petitioner.
