ORDER
The Criminal Revision Case challenges the order of maintenance awarded to the respondents at the rate of Rs.1,00,000/- per month. Pending revision, the parties have arrived at a compromise by which the respondents have agreed to receive Rs.50,00,000/- [Rupees Fifty Lakhs Page No.1 of 5
Only] as one time settlement. The parties have also entered into a compromise and the 'Memorandum of Understanding' dated 12.12.2024, signed by both parties and their respective counsel, is produced before the Court. The terms agreed between the parties, are extracted hereunder: "2.(i) The petitioner had agreed to give a one time full and final settlement of all monetary demands for the maintenance / permanent alimony of the minor daughter Simona Elsie Sherlin, a sum of Rs.50,00,000/- [Rupees Fifty Lakhs Only], for past, present and future. (ii) The 1st respondent had agreed to receive the said sum of Rs.50,00,000/- [Rupees Fifty Lakhs Only] in full an final settlement of all monetary demands for the maintenance / permanent alimony of the minor daughter Simona Elsie Sherlin, the 2nd respondent herein for the past, present and future.
(iii) Pursuant to the above agreement, the petitioner has purchased a Demand Draft bearing No.505277, dated 10.12.2024, for a sum of Rs.50,00,000/- [Rupees Fifty Lakhs Only] drawn on the ICICI Bank, Avadi Branch in favour of the 1st respondent. The said Demand Draft shall be handed over to the 1st respondent before the Hon'ble Court on the date of hearing of this petition.
(iv) The 1st respondent undertakes to withdraw the MP No.525 of 2023 and MP No.527 of 2023 in MC No.292 of 2021 pending on the file of the VII Additional Family Court, Chennai and put an end to all litigations between her and the petitioner in view of this settlement and will not seek to execute the order in MC No.292 of 2021 in view of the settlement.
(v) The petitioner and the 1st respondent hereby agree and state that they will not precipitate any issue between themselves and have no further claim against each other monetary or otherwise. (vi) The parties herein consent to put an end to litigations and Page No.2 of 5
move ahead with their lives independently in view of this Memorandum of Understanding made possible by the Mediation."
2. The above 'Memorandum of Understanding' dated 12.12.2024, is recorded and the Criminal Revision Case, is disposed of in terms of the above 'Memorandum of Understanding'. Consequently, the connected Criminal Miscellaneous Petition is closed.
