Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the 3rd respondent to survey the property in Therku kattu kottai, Koneripatti, Thammampatti post of Gangavalli Taluk in Salem District at S.No.348/1, 220/17, 206/2, in Patta Nos.391 and 1075 according to paid necessary charge in E-Receipt No.2024/0123/08/006535 and further direction directing the 1st and 2nd respondents to consider the representation dated 04/12/2024 and 10/01/2025 within stipulated time limit fixed by this Court.

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents, particularly, the second respondent to act upon the online application submitted by the petitioner on 02.12.2024 wherein the petitioner has sought for survey of the subject property and for demarcation of boundaries.

2. Heard Mr.G.Kumaresan, learned counsel for petitioner and Mr.S.Jayachandran, learned Government Advocate appearing for respondents.

3. The petitioner is placing reliance upon the joint patta that stands in his name. The petitioner wanted a survey to be conducted for demarcation of boundaries and accordingly, an online application was submitted on 02.12.2024 along with necessary charges. Since the same was not acted upon, a representation was made on 10.01.2025, which also did not evoke any response. It is under these circumstances, the present writ petition came to be filed before this Court. 2/4

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the second respondent to deal with the online application submitted by the petitioner on 02.12.2024 and take a decision with regard to conducting survey in the subject property within a period of four (4) weeks from the date of receipt of a copy of this order. If there are any other interested parties, such survey shall be conducted in their presence. This direction is issued in view of the fact that there is a joint patta standing in the name of the petitioner.

This writ petition is disposed of with the above direction. No costs.
