The Writ Petition has been filed for directing the Respondents to pass orders on the representation dated 01.04.2023 made by the Petitioner to give the relieving order and experience certificate.

When it was pointed out that the Respondent is a private Educational Institution, which is not a 'State' within the meaning of Article 12 of the Constitution of India, and the relief sought in the Writ Petition does not relate to enforcement of any public duty for which Writ Petition under Article 226 of the Constitution of India could not be entertained, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition reserving the right of the Petitioner to work out his remedies before the proper forum in the manner recognized by law, and he has also made endorsement to that effect in the court record.

In fine, the Writ Petition is dismissed as withdrawn granting such liberty. 2/4
