The petitioner who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 376, 417 and 506(ii) of IPC, in Crime No.8 of 2020, seeks anticipatory bail.
2. The case of the prosecution is that A1 made a false promise to marry the defacto complainant and had sexual intercourse with her. Thereafter, A1 refused to marry the defacto complainant. Hence, the complaint.
3. The learned counsel for the petitioner submitted that A1 fell in love with the defacto complainant and thereafter, there was misunderstanding between them. He also submitted that A2 and A3 have granted Anticipatory bail in Crl.O.P.No.9113 of 2020, dated 26.06.2020 before this Court. He further submitted that a false case has been foisted against him. Hence, he seeks to grant anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor submitted that A1 has committed rape on the pretext of marriage, thereafter cheated the defacto complainant. He also submitted that A4 is a relative of A1. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case and the fact that there is no change in circumstances, this Court is about to dismiss this petition, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition.
6.In view of the submission made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn. 14.08.2020 Index: Yes/No Internet: Yes/No Speaking/Non-Speaking order vsn
