Respondents (R4 & R5 impleaded vide order dated 08.06.2022 in W.M.P.No.13568 of 2022 in W.P.No.12348 of 2022) PRAYER:Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ in the nature of Writ of Mandamus or any other appropriate writ, direction or order directing the 3rd Respondent to cancel all bogus patta and issue fresh joint Patta for Vacant house sites measuring about 4800 sq.feet (2 Grounds) situated in Survey Nos.375/2 and 375/3, Plot Nos.44 & 45 in Vallalar Nagar, Nandhivaram Village, Chengalpattu Taluk, Chengalpattu District based on my mother's representation dated 26.11.2018 and my representation dated 12.04.2022 within the specific time frame.

ORDER

The present petition has been filed seeking a direction to the 5th Respondent to cancel all bogus patta granted in respect of the subject property and to issue joint Patta with respect to the subject properties in favour of the petitioner's mother pursuant to the representation dated 26.11.2018 made by the petitioner's mother.

2. It is the case of the petitioner that after the demise of the petitioner's father, the subject property was devolved upon the petitioner and her mother. While being so, some unscrupulous elements with an intent to grab the property created some forged documents, based on which, Patta has been granted in favour of them. In order to cancel the bogus patta and to issue joint patta in favour of the petitioner or her mother,the representation dated 26.11.2018 was made to the respondents herein. However, till date, the same has not been considered. Hence, the present petition has been filed.

Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court directs the 3rd Respondent to consider the the representation dated 14.02.2022 made by the petitioner's mother and pass appropriate orders on the same in accordance with law, within the time stipulated by this Court.

4. Learned Additional Government Pleader appearing for the respondents submits that the representation dated 26.11.2018 will be considered and disposed of on merits within the time stipulated by this Court.

5. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case directs the 5th Respondent/Tahsildar to consider the representation dated 26.11.2018 made by the petitioner's mother and dispose of the same in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

6. Accordingly, this writ petition is disposed of with the aforesaid direction. No costs.
