Nagar Police Station, Chennai - 600 083 to not to permit the 3rd respondent herein and their men i.e. the Secretary, Vinayagar Sadhurthi Vizha Kuzhu for putting up the Vinayagar idol and the temporary temple setup in front of the petitioner's house building premises situated at No.96 Pachaiyappan Street, West Jafarkhanpet, Chennai - 600 083 in any manner pertaining to the petitioner's complaint dated 18.08.2015 in accordance with law. This Criminal Original Petition has been filed for a direction to the respondent police not to permit The Secretary, Vinayagar Sadhurthi Vizha Kuzhu, Pachaiyappan 2nd Street, Anjali Mahal Opp. West Jafarkhanpet, Chennai - 600 083 to install the statue of Vinayagar idol in front of the petitioner's house. https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents No.1 & 2 and perused the material placed on record.

3. On instructions, the learned Additional Public Prosecutor submitted that during petition enquiry in the year 2014, the organizers of the Vinayagar Sadhurthi celebrations had installed the Vinayagar idol in front of the petitioner's house on undertaking that in the subsequent years, they will not put the same. Further, the learned Additional Public prosecutor produced the written instructions signed by the Inspector of Police, M.G.R.Nager Police Station, dated 05.09.2015, in which, he has stated that the organisers have given undertaking to the police that they will not install the idol in the front of the petitioner's house.

4. In view of the above, the respondent police shall ensure that the idol is not installed in front of the house of the petitioner by the organisers and effective steps shall be taken to prevent any such installation.
