ORDER
This Petition has been filed, seeking (i) to modify the condition imposed in Crl M.P.No.39552 of 2024 by the learned Metropolitan Magistrate for exclusive trail of CCB Cases relating to cheating cases in Chennai and CBCID Metro Cases at Chennai-08 and (ii) to examine the legality, propriety and correctness of the order dated 26.07.2024 passed in Crl MP.No.39552 of 2024 by the learned Metropolitan Magistrate for exclusive trail of CCB Cases relating to cheating cases in Chennai and CBCID Metro Cases at Chennai-08 and set aside the same. 2.The petitioner is the Company and its Directors are the accused. The accused had cheated by misappropriation to a tune of Rs.5,89,37,961/-. In pursuant to the registration of the FIR, the vehicles owned by the petitioner and its Directors have been seized and produced before the trial Court. The petitioner filed a petition to return the vehicles and the same was allowed on condition that the petitioner shall deposit a sum of Rs.50,00,000/- & Rs.1,00,00,000/- respectively since it is alleged that the 2/5
vehicles have purchased from the crime proceeds. 3.The learned counsel for the petitioner would submit that the petitioner is unable to comply with the condition imposed by the trial Court and as such seeks for modification.
4.The vehicles were seized from the petitioner's Directors viz, A6 to A8. Now, the investigation is completed and a final report is filed and the same has been taken cognizance vide in CC No.6023 of 2023. The petitioner has not made out any reasonable ground to modify the condition. Therefore, this Court does not find any infirmity or illegality in the order passed by the trial Court.
5.Accordingly, this Criminal Original Petition is dismissed. 03-04-2025 dn Index : Yes / No 3/5
