This Original Petition has been filed under Sections 232 and 276 of the Indian Succession Act, 1925, seeking grant of Letters of Administration with Will annexed in respect of the last Will and testament dated 05.11.2020 executed by the deceased testator, S.C. Ranganathan. 2.
The petitioner is the son of the deceased testator. According to the petitioner, the testator died on 16.08.2023 at No.17-A, Sky Villas, Olympia Opaline, Rajiv Gandhi Salai (OMR), Navalur - 600 130. 3.
The petitioner states that the deceased left behind the petitioner and the first respondent as his legal heirs. Respondents 2 and 3 are the children of the petitioner and are also beneficiaries under the Will. The legal heirship certificate has been marked as Ex.P3.

The Will dated 05.11.2020 has been produced before this Court and marked as Ex.P1. Since no executor has been appointed under the Will, the petitioner, being the son of the deceased and a life interest holder/beneficiary under the Will, has sought Letters of Administration with Will annexed. 5.
The respondents have filed consent affidavits stating that they have no objection to the grant in favour of the petitioner. 6.
General paper publication was effected and the learned Master has recorded that service by publication was complete and that no objection was raised by any person.

The matter was thereafter referred to the learned Master for recording evidence. The petitioner examined himself as P.W.1. He marked Ex.P1 to Ex.P10. Ex.P1 is the original Will dated 05.11.2020. Ex.P2 is the death certificate of the deceased. Ex.P3 is the legal heirship certificate. Ex.P4 to Ex.P7 are title documents relating to the schedule properties. Ex.P8 series are 3/8
the paper publications. Ex.P9 is the affidavit of assets. Ex.P10 is the certificate under Section 63(4)(c) of the Bharatiya Sakshya Adhiniyam, 2023. 8.
The first attesting witness, K.S. Suresh, was examined as P.W.2. He has stated that the testator executed Ex.P1 Will on 05.11.2020 in his presence and in the presence of the other attesting witness, R. Chenthil Selvan. He has further stated that the testator was in a sound state of mind and in good health at the time of execution of the Will, that the testator signed the Will in their presence, and that both attesting witnesses signed the Will at the request of the testator. The Aadhaar card of P.W.2 has been marked as Ex.P11. 9.
The evidence of P.W.2 satisfies the requirement of proof of execution and attestation of the Will. There is no caveat or objection opposing the grant. The respondents, who are interested persons, have consented to the grant. 10.
The affidavit of assets shows the gross value of the estate as Rs.6,70,00,000/- and the net value as Rs.6,69,80,000/-. 4/8

The petitioner has undertaken to duly administer the estate and credits of the deceased, to pay the debts first, if any, and thereafter the legacies, to file a full and true inventory within six months from the date of grant, and to render true accounts within one year from the date of grant.

On consideration of the pleadings, documents and evidence, this Court is satisfied that the Will dated 05.11.2020 executed by the deceased testator S.C. Ranganathan has been duly proved and that the petitioner is entitled to Letters of Administration with Will annexed.

Accordingly, O.P.No.363 of 2025 is allowed. The Registry shall issue Letters of Administration accordingly, to have effect throughout India; The petitioner is directed to execute a security bond for a sum of Rs.25,000/ (Rupees Twenty five Thousand only) in the name of the Assistant Registrar (Original Side) of this Court. The petitioner shall file a full and true inventory of the estate within six months from the date of receipt of the Letters of Administration and shall render a true and proper account within one year thereafter. No order as to costs. 5/8
