2. It is the case of the prosecution that the petitioner is alleged to have transported six units of sand illegally. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner was permitted to take the sand for the construction work undertaken in B-3 Police Station, Fort St.George, Chennai, for which, temporary pass also has been issued by the Assistant Executive Engineer, Chennai Division -II, Tamil Nadu Police Housing Corporation Ltd. Merely, because the petitioner has deposited the said amount, it would not amount to admission of his guilt. Therefore, it is open to the trial Court to deal with the case independently.

Accordingly, the petitioner is directed to deposit a sum of Rs.30,000/- (Rupees Thirty Thousand only) as non refundable deposit to the credit of the District Legal Services Authority, Tiruvallur district within a period of four weeks from the date of normal functioning of the Court below and on such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate - I, Tiruvallur District, on condition that the petitioner shall execute a bond for a sum of Rs.
