2 N.MAYAVEL Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant an order of Interim stay of all further proceedings with respect of ID.No.2/2015 on the file of Labour court, Cuddalore (CMP.13909/2019) pending disposal of the above WA.2066/2019 Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.NALLIYAPPAN, Advocate for the petitioner the court made the following order:- [Order of the Court was made by M.M.SUNDRESH, J.] Heard the learned counsel appearing for the petitioner. Despite service of notice and the name of the second respondent having been printed in the cause list, there is no representation.

Learned counsel appearing for the petitioner submitted that the Labour Court has not considered the relevant materials and the learned Single Judge merely confirmed it without going into the issue raised.

The entitlement of backwages is not a matter of right. Considering the above, there shall be an order of interim stay pending disposal of the appeal.
