Appeal Suit is filed under Section 96 r/w Order 41 Rule 1 & 2 of the Code of Civil Procedure 1908, against the Judgement and Decree dated 05.03.2008 made in I.A.No.3010 of 2007 in O.S.No.1787 of 2001 on the file of the VI Additional Judge, City Civil Court, Chennai.

For Appellant : Mr.K.A. Vimal Kumar For Respondent : Mr.A. Palaniappan JUDGEMENT The appeal is directed against the final decree passed in O.S.No.1787/2001 on the file of the VIth Additional City Civil Judge, Chennai.

2.The parties have entered into compromise and a memo of compromise has also been filed. As per the memo of compromise, the suit property has been divided into Eastern and Western portions with a common passage on the Northern side. The Eastern portion has been allotted to the respondent-Meenakshi, and the Western portion has been allotted to the appellant-Indraniammal.

3.Both the appellant and the respondent are present and they have affirmed the factum of compromise. Hence the compromise memo is recorded. The judgement and the decree of the trial Court will be substituted by a decree in terms of the compromise. The memo of compromise will form a part of the decree.

The property shown in the schedule "B" is allotted to Indiraniammal-the appellant https://hcservices.ecourts.gov.in/hcservices/

and the property shown in schedule "C" is allotted to Meenakshi-the respondent. There shall be no order as to costs in the appeal.
