No.2617/ GEN/ 2024/ Green dated 12.12.2024 and to quash the same and direct the respondent to return the documents pertaining to the two agricultural properties situated at Salem and Namakkal districts comprised on Property 1 Patta No.1477 Old Survey Nos.332/1A2, 340/2, 341/2 and 344/3B in Mathuruttu Village and Panchayat, Namagiripettai Union Limit, Rasipuram Taluk, Namakkal District to the extent of approximately 10 Acres

and property 2 Patta No.729, Survey No.142/2B in Umaiyalpuram, Vadugathampatty Village and Panchayat Petanaickenpalayam union Limit, Pethanaickenpalayam Taluk, Salem District to an extent of approximately 2.47 Acres which were registered as Document Nos.5041/2020 on 28.12.2020 and 564/2021 on 4.2.2021 in favour of 2nd respondent bank as collateral security for the loan transaction covered under loan in fresh BG (ST) sanction limit to the tune of Rs.4.00 crores which was not drawn by the petitioner. ORDER

This petition has been filed by the petitioner to call for the records relating to the orders of the 2nd respondent in Ref. No.2617/ GEN/ 2024/ Green dated 12.12.2024 and to quash the same and direct the respondent to return the documents pertaining to the two agricultural properties situated at Salem and Namakkal districts.

When the matter was taken up for hearing today, it is brought to the notice of this Court that the impugned order has not complied with the directions issued by this Court in W.P.No.32324 of 2024 by an order dated 29.10.2024, wherein this Court had passed the following order: "6.In view of the aforesaid submissions, this Court without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 02.09.2024 on merits and in accordance with law and pass appropriate orders within a period of two

weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and aggrieved persons, if any."

A mere reading of the impugned order would clearly highlight that the same has not been passed in tune with the above directions of this Court. 3.

Therefore, the impugned order is set aside and the matter is remitted back to the second respondent who shall consider and pass orders afresh, after issuing notice of enquiry to the petitioner, hearing the petitioner and thereafter, pass the speaking orders. The said exercise shall be completed by the second respondent within a period of two months from the date of receipt of a copy of this order.
