Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Mandamus, directing the respondents to pay interest for the period from 01.06.2012 till 13.02.2014 for the belated disbursement of retirement benefits, i.e., gratuity on 14.02.2014 by considering the representation of the petitioner dated 29.05.2014 within a period to be specified by this court.

ORDER

The petitioner joined as a Secondary Grade Teacher on 01.11.1989. On 12.08.1998, he was promoted to the post of Elementary School Headmaster and he was further promoted as Middle School Headmaster on 01.12.2004. He was lastly promoted as Assistant Elementary Educational Officer on 26.07.2005. He retired from service on reaching the age of superannuation on 31.05.2012. Now, his grievance is that he was settled with the DCRG amount only on 14.02.2014, that is, after a period of twenty months from the date of his retirement. According to him, he made a representation to the respondent on 29.05.2014 requesting them to pay interest for the belated settlement of DCRG amount. But, till date there is no response. Hence, he has come forward with this writ petition seeking to issue an appropriate direction to the respondents to consider his representation for interest towards belated settlement of DCRG amount for the period from 01.06.2012 to 13.02.2014. https://hcservices.ecourts.gov.in/hcservices/

2. I have heard Mr.S.Mani , the learned counsel for the petitioner and Mrs.M.E.Rani Selvam, the learned Additional Government Pleader, who takes notice for the respondent and also perused the records carefully.

3. Considering the the limited scope of the prayer sought for by the petitioner and the facts and circumstances of the case, this court, without going into the merits of the case, directs the respondents to dispose of the representation of the petitioner dated 14.02.2014 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. This Writ petition is, accordingly, disposed of. No costs.
