Singaravelu ..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, for a direction, (i) forbearing the 2nd and 3rd Respondents from Conducting any survey in S.F.No.789/2 measuring to an extent of 2.24 acres situated at Jerthalav Village, Makkankottai, Palacode Taluk, Dharmapuri District which is subject matter of suits in A.S. No.29 of 2025 pending on the file of the Principal District Court, Dharmapuri and O.S.No. 28 of 2023 on the file of the District Munsif Court Palacode, till the disposal of the same by considering the petitioner's representation dated 12.03.2026. (ii)

directing the respondents 2 and 3 not to dispossess the petitioner from in S.F.No. 789/2 to an extent of 2.24 acres situated at Jerthav Village, Makkankottai, Palacode Taluk, Dharmapuri District, in the guise of conducting survey.

O R D E R

This Writ Petition has been filed to forbear the 2nd and 3rd respondents from conducting any survey for the properties morefully disclosed in the prayer to this Writ Petition.

2.The interest of the petitioner has already been protected by this Court through this Court's order dated 16.02.2026 passed in W.P.No.4286 of 2026. The very same property herein was the subject matter of W.P.No.4286 of 2026. While issuing a direction for survey and demarcation of boundaries through this Court's order dated 16.02.2026 passed in W.P.No.4286 of 2026, it has been made clear by this Court that before surveying the lands in question, the respondent (official respondent) is directed to issue notice to the neighbouring land owners, if any and also to any other third party, whom the respondent deems it fit to put on notice. It is made clear that only after receiving the

objections if any and after considering the same, the respondent (official respondent) shall conduct survey and demarcate the boundaries of the property. The petitioner, who is an interested party will certainly be issued notice by the official respondents before demarcating the boundaries of the subject property. 3.Since the interest of the petitioner has already been protected by this Court through this Court's order dated 16.02.2026 passed in W.P.No.4286 of 2026, this Writ Petition is disposed of by directing the respondents to strictly comply with the directions issued by this Court on 16.02.2026 in W.P.No.4286 of 2026, by hearing the objections of the petitioner in this Writ Petition and only after giving due consideration to the same, shall survey and demarcate the boundaries as directed by this Court in this Court's order dated 16.02.2026 passed in W.P.No.4286 of 2026.
