Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to survey the land with aid of the second respondent in respect of agricultural lands comprised in S.No.240/4 measuring an extent of 0.5.00 hectare, S.No.243 extent of 0.26.5 hectare, S.No.232/2 an extent of 0.21.00 hectare and S.No.0.83.50 hectare situated at Barur Village, Pochampalli Taluk, Krishnagiri District.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the first respondent to survey the agricultural lands of the petitioner with aid of the second respondent in respect in S.No.240/4 measuring an extent of 0.5.00 hectare, S.No.243 extent of 0.26.5 hectare, S.No.232/2 an extent of 0.21.00 hectare and S.No.0.83.50 hectare situated at Barur Village, Pochampalli Taluk, Krishnagiri District.

3. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that the subject agricultural lands are his ancestral properties and the same has been acquired by the petitioner by way of a family partition deed dated 05.09.1994 and revenue authorities have also issued patta in the name of the petitioner for the subject properties. The grievance of the petitioner is that though he has given an application on 05.05.2023 and also paid necessary fees for surveying his land and fix 2/4

boundaries, the respondents have not taken any action in this regard. Hence, the present Writ Petition.

5. Considering the limited relief sought for in this writ petition, there shall be a direction to the respondents to dispose of the application of the petitioner dated 05.05.2021 to survey the land of the petitioner and fix its boundaries after giving notice to the neighbouring land owners and any other interested persons, within a period of two months from the date of receipt of a copy of this order.
