CORAM

THE HONOURABLE MR.JUSTICE SATRUGHANA PUJAHARI W.P.No.22611 of 2018 and W.M.P.No.26463 of 2018 M.Kumar ....Petitioner Vs

1. The Chairman, Teacher Recruitment Board, College Road, Chennai - 600 006

2. The Director of School Education, College Road, Chennai-600 006 ..

Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the first respondent to appoint the petitioner as Drawing Teacher (Special Teacher) as the mark secure by the petitioner Under the Tamil Medium Study Certificate quota, by taking in to account the qualification prescription Special Rule for Tamil Nadu School Educational Subordinate Service Rules for Drawing Teacher.

For Petitioner : Mr.P.Ganesan For Respondents : Mrs.P.Kavitha Government Advocate

ORDER

Heard, the learned counsel for the petitioner and Mrs.P.Kavitha, learned Government Advocate appearing for the respondents.

2. The grievance of the petitioner in this case is that though he has possessed the Tamil Medium Study Certificate and fully qualified having secured 43 marks still he has not been called for certificate verification in the recruitment examination for the post of Drawing Teacher (Special Teacher) conducted by the first respondent whereas some unqualified persons who had not furnished their certificates as required in the advertisement, have been included in the provisional list https://hcservices.ecourts.gov.in/hcservices/

of candidates for certificate verification. The petitioner has mentioned that some persons have been included in the list who do not possess the necessary certificate that is Tamil Medium Study Certificate. Hence, the petitioner has made a prayer to direct the respondents to appoint him as Drawing Teacher on verification of the certificate.

3. However, the petitioner has made such allegation that unqualified persons are included and though he being qualified has been excluded. The persons from his category included in the list have secured more marks and have been called for certificate verification. There is no substance in the allegation of the petitioner that those persons do not possess the necessary certificate as required in the advertisement. Such allegation of the petitioner in this regard therefore, appears to be wild one

4. Hence, this Court is of the view that the writ petition is without any substance and as such stands dismissed.

Consequently, connected miscellaneous petition is closed. However, in the circumstances, there shall be no order as to costs.
