Prayer: Criminal Original Petition filed under Section 438 Cr.P.C., praying to enlarge the petitioners on bail in the event of their arrest in Crime No.67 of 2019, pending investigation on the file of the Respondent police.

ORDER

(The case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 and 430 of IPC in Crime No.67 of 2019, on the file of the respondent police, seeks anticipatory bail.

2. It is the case of the prosecution that the petitioners are alleged to have transported three units of sand illegally by using Tipper Lorry without any valid licence. Hence the complaint.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent person and they have been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the quantity of sand involved is three units. He further submitted that there there are two previous cases pending against the petitioners. Hence, he opposed for the grant of https://hcservices.ecourts.gov.in/hcservices/

anticipatory bail to the petitioners.

5. Taking into consideration the allegations and also the bad antecedent of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
