No.III, Coimbatore, confirming the judgment and decree passed in O.S.No.59 of 2004 dated 26.08.2009 on the file of the Sub Court, Pollachi.

O R D E R

The prayer sought for in the present appeal is to set aside the judgment and decree made in A.S.No.147/2009 dated 20.04.2011 on the file of the Additional District and Sessions Court, FTC. No.III, Coimbatore, confirming the judgment and decree passed in O.S.No.59 of 2004 dated 26.08.2009 on the file of the Sub Court, Pollachi.

2. Today, when the matter is taken up for consideration, the learned counsel for the appellant seeks permission of this Court to withdraw the present second appeal . He has also made an endorsement to that effect.

3. Recording the submissions made by the learned counsel for the appellant, the present second appeal is dismissed as withdrawn. Consequently, the connected Miscellaneous Petition is closed.
