Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorari, calling for the records of the second respondent herein pertaining to the demolition notice dated 31.12.2014 made in Na.Ka.No.2124/E1/Na.Ma/ 2014 and quash the same and as well as the building stability certificate issued by the third respondent herein dated 31.12.2014 made in ROC No.2124/E1/NZ/2014 which was relied on by the second respondent herein for issuing the above demolition notice.

ORDER

(Order of the Court was made by SATISH K. AGNIHOTRI, J.) The learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty and he has also made an endorsement to the following effect:

"I may be permitted to withdraw this writ petition with liberty to approach the Civil Court with the pleas raised in this writ petition."

In view of the above said submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn, with liberty to the petitioner to raise all the issues in the pending suit, if so advised. No costs. Connected Miscellaneous Petitions are closed.
