This Application is filed to condone the delay of 449 days in filing the written statement.

2. In the affidavit filed in support of the judges summons, it had been stated that when the suit was referred to mediation, the defendant was involved in the mediation process, which prevented the defendant from forwarding necessary instructions to his counsel.

3. Being satisfied with the reasons stated in the accompanying affidavit, the delay is condoned and the written statement is taken on file.

4. Post the matter on 14.10.2022 for framing of issues.
