ORDER

The petitioner who was arrested on 04.05.2021 and remanded to judicial custody for the offences under Sections 294(b), 323, 324 and 307 of IPC in Cr.No.269 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on the date of occurrence, when the defacto complainant was having lunch in a mobile food stall, a wordy quarrel arose between the petitioner and the defacto complainant and subsequently, the defacto complainant was attacked by the petitioner herein with wooden log. Further that the petitioner snatched the chain of the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) vehemently opposed for grant of bail to the petitioner stating that the petitioner is a history sheeter and that there are 9 previous cases pending as against the petitioner. He further added that if the petitioner is enlarged on bail, there is a chance of the investigation being https://hcservices.ecourts.gov.in/hcservices/

hampered and witnesses being threatened. He however concedes that the defacto complainant had been discharged from the hospital, having suffered head injuries.

5.Considering the fact that the petitioner is a history sheeter and that there are 9 previous cases of similar nature pending against the petitioner, this is not a fit case for grant of bail. 6.Therefore, this Criminal Original Petition is dismissed. -sd/- 27/05/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
